Monitoring

Who is responsible for monitoring CUF?

  • Everybody working on or administering the contract
    • Project Engineers (Engineers-in-Charge, Resident Engineers, Construction Quality Control Engineers, Construction Quality Assurance Engineers)
    • Office Engineers
    • Inspectors
    • Compliance Specialists
  • Red Flags are indicators that require further review; they are not an "automatic fail" of CUF

  • Monitoring is a team effort - everybody has a role

  • Briefly (1-2 sentences) record observations of how the DBE is performing in contract records such as:
    • Project Diary
    • Inspection Reports
    • Site Visit Checklist/Report
    • (usually completed by a Compliance Specialist, an observer from another agency, etc.)

  • Maintain a copy of all reports, schedules, correspondence, etc., in the field

  • Ensure that the work of the Contractor conforms to the provisions of the contract documents

  • THE DBE REQUIREMENTS ARE CONTRACT REQUIREMENTS (see §102-12 and §105-21)

  • These requirements are to be monitored, reported and documented just like any other contract specification

  • Any deviation from the Schedule of Utilization and/or Utilization Worksheet is a contract breach similar to the Contractor deliberately using inferior materials

  • When you become aware of any deviations from the Schedule of Utilization and/or Utilization Worksheet, contact the Contractor to determine whether the deviation is a misunderstanding that can be easily corrected

  • Inform the Compliance Specialist immediately

  • If the deviation is a change for which the Contractor did not obtain approval, a stop work order should be issued for the operation in question

  • Document all meetings and issue minutes
