Key Element: Performance
The DBE firm must perform the following functions:
- Carry out work that is distinct from the Contractor or another
Subcontractor
- Carry out work that is designated under the Utilization Worksheet and
associated subcontracts/purchase orders
- Manage its work
- Coordinate schedules and operations
- Supervise its own employees
- Use its own equipment
- Provide materials/supplies
Red
Flags: Performance
- The DBE's work cannot be distinguished from the Contractor's or
another Subcontractor's work
- The DBE firm did not carry out the work that is designated under the
Utilization Worksheet and associated subcontracts/purchase orders
- The Contractor or other Subcontractor directed the DBE's employees,
including the DBE's superintendent
- The DBE firm shared employees and/or supervision with the Contractor
or other Subcontractor
- The DBE shared or borrowed equipment belonging to the Contractor
or other Subcontractor
- The Contractor or other Subcontractor provided materials
