Key Element: Workforce/Labor
The DBE firm must perform the following functions:
- Maintain its own workforce - including administrative and clerical
staff
- Not share employees with Contractor or another Subcontractor on the
contract (or affiliate of either)
- Perform or exercise responsibility for at least 30 percent of the
total cost of its contract with its own work force
- Hire/Fire employees, including union employees
- Prepare and submit payroll
- Pay employees directly

- DBE's employees usually work for the Contractor or other Subcontractor
- Contractor or other Subcontractor hires/fires DBE's employees
- DBE's employees appear on Contractor's or other Subcontractor's
payroll
- DBE's payroll is prepared by the Contractor or other Subcontractor
- Contractor or other Subcontractor delivers paychecks to DBE's employees
- DBE's employees don't identify DBE firm as their employer
