CUF Assessment:
Key Element: Workforce/Labor

The DBE firm must perform the following functions:

  • Maintain its own workforce - including administrative and clerical staff
    • Not share employees with Contractor or another Subcontractor on the contract (or affiliate of either)
    • Perform or exercise responsibility for at least 30 percent of the total cost of its contract with its own work force
  • Hire/Fire employees, including union employees
  • Prepare and submit payroll
  • Pay employees directly

Red Flags: Workforce/Labor

  • DBE's employees usually work for the Contractor or other Subcontractor
  • Contractor or other Subcontractor hires/fires DBE's employees
  • DBE's employees appear on Contractor's or other Subcontractor's payroll
  • DBE's payroll is prepared by the Contractor or other Subcontractor
  • Contractor or other Subcontractor delivers paychecks to DBE's employees
  • DBE's employees don't identify DBE firm as their employer
